Per the first ammendment, Kimmel can say whatever (with few excpetions) he wants. Kimmel’s issue is his arrogance and deiliction of responsibility. If you are/were a stockholder in ABC (including Kimmel’s show) you’d expect the host of a late night talk show to be funny, appeal to as many people as possibles and generate audience numbers that would pay his huge salary and make the company and stockholders money. That’s the goal. For him to disregard his fiduciary and business responsibility and alienate (i.e. eliminate) half the potential audience (profit!) is not his call. He was hired to maximize audience and profit by being funny. He has openly admitted he hasn’t done what he was hired to do. Whatever your job may be or has been, we are all hired to do a job or face the consequences. a simple concept.
